Terms & Conditions: Golden Hour VR


1. INTRODUCTION AND ACCEPTANCE OF TERMS
These Terms & Conditions of Service (“Terms”) constitute a binding legal agreement between you
(“you” or “Participant”) and Taloc LLC, a California limited liability company doing business as Golden
Hour VR (“Golden Hour VR,” “we,” “our,” or “us”).
By accessing our premises, scheduling a session, completing a booking, or participating in any immersive
virtual reality experience, simulation, or physical activity offered by Golden Hour VR (collectively, the
“Services”), you agree to be bound by these Terms, our Privacy Policy, and any other policies
referenced herein.
If you do not agree to these Terms, you may not participate in any Services or access our facility.
These Terms are governed by the laws of the State of California and include a binding arbitration clause
and waiver of class actions and jury trials (see Section 11).
 
2. SERVICES OFFERED AND ELIGIBILITY
Golden Hour VR provides immersive virtual reality experiences, games, and simulations to the general
public, subject to the following conditions:

  • You must be at least 18 years of age, or a minor accompanied by a parent or legal guardian

who has signed an enforceable waiver and consent agreement.

  • Participants must be in adequate physical and mental health to engage in activities involving

motion, visual stimulation, and wearable technology.

  • Participants must wear closed-toe shoes with secure heel straps at all times. Sandals, flip-flops, high heels, or barefoot participation is prohibited for safety reasons.

  • Certain VR experiences may have age recommendations established by content developers. Parents/guardians are responsible for determining age-appropriate content for minors in their care.

  • Golden Hour VR reserves the right to deny access to any individual who, in its sole discretion,

appears to be intoxicated, unfit to participate, or poses a safety risk to themselves or others.

  • All participants must sign a liability waiver before engaging in any Service. For minors, a parent

or legal guardian must sign on their behalf.​

  • Participants agree to comply with all posted facility rules, instructions from staff, and safety

guidelines provided prior to or during any session.


Violation of these conditions may result in immediate removal from the premises without refund.
 
3. BOOKINGS, PAYMENTS, AND SESSION POLICIES
a. Booking and Reservation
All Services must be booked in advance through our official booking platform, accessible at
www.goldenhourvr.com. A booking is confirmed only upon receipt of payment and acceptance of these
Terms.

  • You are responsible for ensuring the accuracy of your booking information, including date, time,

number of participants, and contact details.

  • By completing a booking, you represent that you have the authority to bind all individuals in

your party to these Terms.

Golden Hour VR reserves the right to:

  • Modify or cancel session times;

  • Refuse or terminate a booking at its sole discretion, particularly in the interest of participant

safety, public health compliance, or technical constraints.


b. Payment Terms
All prices are listed in U.S. dollars and are subject to applicable taxes and fees.

  • Payment is due in full at the time of booking, unless otherwise noted.

  • We accept major credit cards and other payment methods as listed on our booking platform.

  • By submitting payment information, you authorize us to charge the full session amount to your

designated payment method.
Golden Hour VR does not store your payment information directly. All transactions are processed
through PCI-compliant third-party providers such as Stripe and Wix Payments.


c. Refund and Cancellation Policy
Your booking is governed by the following refund policy:

  • Cancellations made more than 25 hours in advance of your scheduled session:

→ Eligible for a full refund or one-time complimentary rescheduling.

  • Cancellations made within 24 hours of your scheduled session:

→ Subject to a $20 per participant cancellation fee, up to a maximum of $80 per group session.

  • No-shows and same-day cancellations:

→ Non-refundable. No rescheduling or credit will be provided.

All refund requests must be submitted via email to info@goldenhourvr.com with your booking
reference number. Refunds are issued to the original form of payment and may take 5–7 business days
to process.
Golden Hour VR reserves the right to waive or modify fees on a case-by-case basis, at its sole discretion.
 
4. WAIVER AND ASSUMPTION OF RISK REQUIREMENT
Prior to participation, all guests must complete and sign a valid waiver of liability, either electronically
or in person, acknowledging the inherent risks of immersive VR activities.

  • The waiver must be signed for each participant and is valid only for the specified booking.

  • Waivers include acknowledgment of risks, release of liability, media consent options, and agreement to these Terms.

  • For minors under the age of 18, a parent or legal guardian must sign on their behalf and acknowledge age-appropriate content selection

  • Golden Hour VR reserves the right to verify identity before permitting entry.

  • Participation without a signed waiver is strictly prohibited. Failure to execute the required waiver may
    result in denied access without refund.

5.  FACILITY RULES AND PARTICIPANT CONDUCT

Participants are expected to: -

  • Follow all posted safety guidelines and staff instructions;

  • Treat equipment, facilities, and other participants with respect; 

  • Refrain from disruptive, unsafe, or inappropriate behavior;

  • Wear appropriate closed-toe footwear at all times

  • Notify staff immediately of any safety concerns or equipment malfunctions.

Prohibited conduct includes, but is not limited to:

  • Intoxication or impairment;

  • Aggressive, threatening, or harassing behavior toward staff or other participants;

  • Intentional misuse or damage to equipment

  • Wearing inappropriate footwear (sandals, flip-flops, high heels, or going barefoot);

  • Recording or photographing without express written permission.

  • Golden Hour VR reserves the right to deny or terminate participation at any time for

noncompliance, disruptive conduct, intoxication, or any behavior deemed unsafe—without refund.

b. Prohibited Conduct
The following actions are strictly prohibited while on the premises:

  •  Damaging, altering, or tampering with VR hardware, software, or facility infrastructure;

  • Attempting to record gameplay without permission from Golden Hour VR;

  • Bringing weapons, hazardous materials, or prohibited items into the facility;

  • Any action that endangers the safety of others, including reckless movement, physical

intimidation, or intentionally colliding with props or participants.


c. Equipment Damage and Liability
Participants are responsible for using all equipment as instructed.

  • Any damage caused to headsets, haptic gear, controllers, sensors, or other property due to

recklessness, intentional conduct, or failure to follow instructions may result in a fee for repair
or replacement, not to exceed $1,000 per incident.

  • Golden Hour VR may seek compensation through billing, insurance, or legal remedies if

necessary. 


6. HEALTH AND SAFETY DISCLAIMERS
By participating, you confirm that you do not have any medical or psychological condition that would
make participation in immersive VR experiences unsafe, including but not limited to:

  • Epilepsy or seizure disorders;

  • Vertigo or severe motion sensitivity;

  • Heart disease, hypertension, or respiratory conditions;

  • Anxiety, PTSD, or conditions that may be triggered by immersive or sensory-rich environments;

  • Recent surgery, head injuries, or significant musculoskeletal limitations.

Golden Hour VR does not provide medical supervision or evaluation. You are responsible for
determining your own fitness to participate.

Golden Hour VR may use technology that captures limited biometric data, including motion tracking,
body positioning, and facial mapping. This data is used solely to enhance gameplay and is processed
through third-party VR systems.
If you have concerns about health, privacy, or participation risks, please speak to a staff member before
your session.
 
7. MEDIA CONSENT AND PHOTOGRAPHY POLICY
Golden Hour VR may, from time to time, capture photographs, video recordings, or audio during
gameplay or while guests are on premises. These media assets may be used for:

  • Promotional or marketing purposes (e.g., social media, websites, brochures);

  • Internal training and quality control;

  • Archival and operational documentation.

By participating in Services at Golden Hour VR, you consent to the use of your image, likeness, voice,
or recorded presence, unless you expressly opt out in advance by submitting a written notice to
info@goldenhourvr.com prior to your session.
If you are the parent or legal guardian of a minor, you will be provided with a media consent selection as
part of the minor waiver process. Golden Hour VR does not photograph or record minors without signed
parental authorization.
All media remains the property of Golden Hour VR and may be edited, published, or distributed in any
format without compensation.
 
8. PRIVACY POLICY AND DATA COLLECTION PRACTICES
Golden Hour VR respects your privacy and is committed to compliance with the California Consumer
Privacy Act (CCPA) and California Privacy Rights Act (CPRA).
Our [Privacy Policy] explains:

  • What personal data we collect (e.g., name, contact info, booking history, digital waiver

signatures);

  • What biometric or session data may be captured by VR equipment;

  • How and where data is stored (e.g., Wix, Stripe, Collect for Stripe);

  • Your rights to access, correct, or delete your data;

  • How to opt out of certain uses of your information.

We do not sell or share your personal information for cross-context behavioral advertising. If this ever
changes, we will notify you and provide a clear opt-out mechanism.

9. COOKIES AND WEBSITE TRACKING
Golden Hour VR’s website may use cookies or tracking technologies for purposes including:

  • Analytics (e.g., Google Analytics, Meta Pixel);

  • Booking functionality and performance;

  • User experience optimization.

You may manage your cookie preferences via your browser settings. Continued use of our website
constitutes consent to our use of these technologies in accordance with our Privacy Policy.
We do not track personal browsing history beyond our platform.
 
10. GOVERNING LAW, DISPUTE RESOLUTION, AND
ARBITRATION
These Terms and any dispute arising from your use of the Services or attendance at Golden Hour VR
shall be governed by the laws of the State of California, without regard to its conflict of laws rules.


a. Binding Arbitration Agreement
You agree that any dispute, controversy, or claim arising out of or relating to these Terms, your
participation in Golden Hour VR’s Services, or your relationship with the Company shall be exclusively
resolved through final and binding arbitration, administered by JAMS under its Comprehensive
Arbitration Rules and Procedures, and conducted in Ventura County, California.
This includes, without limitation:

  • Claims for personal injury, property damage, or emotional harm;

  • Claims arising from negligence, facilities, or equipment use;

  • Disputes concerning refunds, cancellations, or business practices.

b. Waiver of Jury Trial and Class Action
By agreeing to these Terms, you and Golden Hour VR each:

  • Waive the right to a jury trial;

  • Agree that disputes must be brought in an individual capacity only and not as part of a class or

representative action.

If a court or arbitrator finds that any part of this arbitration agreement is unenforceable, the remainder
shall remain in full force and effect, and the dispute shall still be resolved through arbitration wherever
legally permissible.
 
11. MODIFICATIONS TO TERMS
Golden Hour VR may revise these Terms from time to time to reflect changes in law, technology, our
business model, or participant feedback. Updated Terms will be posted on our website and identified by
a new effective date.

  • Your continued use of the Services after any update constitutes acceptance of the revised

Terms.

  • It is your responsibility to review these Terms periodically.

  • If you do not agree to a revision, you must discontinue your participation in Services.

 
12. ENTIRE AGREEMENT AND ENFORCEABILITY
These Terms, along with the Privacy Policy and any executed waiver, represent the entire legal
agreement between you and Golden Hour VR.

  • No oral statements, advertisements, or other representations may modify these Terms unless

expressly stated in writing and signed by an authorized representative.

  • If any provision of these Terms is found to be unenforceable, the remaining provisions shall

remain valid and binding to the fullest extent permitted by law.
